Two Suspects Charged in Malindi with Indecent Acts of Sexual Offences

Two suspects appeared before magistrate Grace Muteti charged with indecent acts of sexual offences in a Malindi court.

Fatuma Mohamed Faitha and Nafisa Abdul Rashid were accused of participating in unlawful acts of causing children aged three to six years to engage in indecent acts with a South African citizen Micheal Ballantine between August 1, 2024 and August 22, 2024.

The accused pleaded not guilty to the charges  which are contrary to section 6 (b) (II) of Sexual Offences Act No.3 of 2006.

The suspect’s lawyer James Muoko requested the court to give his clients bonds while the case proceeds.

However, the resident magistrate Grace Muteti denied them bond bacause it could interfere with ongoing investigations.

Muoko also requested the court to allow Fatuma to be remanded at Malindi children’s home because she is 17 years of age.

The magistrate agreed to the request and ordered the under age suspect to be remanded at Malindi children’s home while her co-accused was remanded at Malindi prison.

Atiang, the prosecutor, requested the court to issue summons to investigating officer to produce Micheal  Ballantine to court and update the court over the same. The magistrate ordered so.

The magistrate also directed the matter to be mentioned on September 19, 2024 for further directions.
